These Terms and Conditions of the BERHUG online store have been prepared in accordance with the applicable legislation of the Republic of Slovenia, in particular the Consumer Protection Act (ZVPot-1), the Electronic Commerce Market Act (ZEPT), the Obligations Code and applicable personal data protection regulations.
The BERHUG online store is operated by:
Robas d.o.o., Trading Company
Potoki 8
4274 Žirovnica
Slovenia
Company registration number: 5781116000
VAT identification number: SI22975039
The company is registered for VAT.
Email for orders, complaints and returns: narocilo@robas.si
Website: www.berhug.com
Hereinafter, Robas d.o.o. is referred to as the Provider, Seller or BERHUG, while visitors to the website and customers are referred to as Users or Customers.
These Terms and Conditions govern the operation of the BERHUG online store, the rights and obligations of the Provider and Users, and the business relationship between the Provider and Customers.
Customers may be natural or legal persons. Provisions relating to consumer rights apply exclusively to natural persons purchasing products for purposes outside their trade, business or profession.
By placing an order, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
Before an order is placed, the Provider undertakes to provide Customers with the following information:
Information about the Provider;
Essential characteristics of the products;
Product prices, including taxes;
Any additional delivery charges;
Available payment and delivery methods;
The validity period of the offer;
Conditions and deadlines for withdrawal from the contract;
Product return conditions;
Information about the Seller's liability for non-conforming goods;
Information about the complaints procedure.
The range of products available in the online store may change.
The Provider makes every effort to ensure that product information, descriptions, photographs, dimensions, capacities, colours and other characteristics are presented as accurately as possible.
Minor differences in colour or appearance may occur due to different screen settings, lighting during photography or variations between production batches.
Such minor variations that do not affect the product's intended use or essential characteristics do not constitute a lack of conformity.
Product photographs are intended for illustrative purposes. In the event of discrepancies between a photograph and the written product description, the written description shall prevail, unless it is clearly incorrect.
All prices in the online store are displayed in euros (EUR) and include VAT unless expressly stated otherwise.
The price applicable to a purchase is the price displayed when the order is placed.
Delivery costs are displayed separately before the order is finally confirmed, unless delivery is free or included in the product price.
The Provider reserves the right to change prices without prior notice. Price changes do not affect orders that have already been placed and confirmed.
In the event of an obvious pricing error, for example due to a technical fault, incorrect data entry or malfunction of the online store, the Provider will notify the Customer and allow them to confirm the order at the correct price or cancel it free of charge.
Promotional codes, coupons, discounts and other benefits are subject to the conditions specified in the relevant promotional offer.
Discounts and promotional codes generally cannot be combined unless expressly stated otherwise.
Only one promotional code may be used per order unless the online store allows otherwise.
Promotional codes generally cannot be applied retroactively after an order has been placed.
The Provider may specify a minimum order value, validity period, eligible products and other restrictions for individual promotions.
Purchases may be made without registering a user account if the online store allows guest checkout.
The Customer selects a product, its characteristics and quantity, and adds it to the shopping cart.
Before placing an order, the Customer can review the contents of the cart, change product quantities, remove products, enter a promotional code and check the total price and delivery costs.
The Customer then enters the information required to process the order, selects a delivery and payment method, and confirms the order.
The Customer is responsible for providing accurate and complete information.
The Provider is not responsible for delays or other problems resulting from an incorrect address, telephone number, email address or other information provided by the Customer.
An order is placed when the Customer clicks a button that clearly indicates that placing the order entails an obligation to pay.
After placing an order, the Customer receives an order receipt confirmation at the email address provided.
The sales contract between the Provider and the Customer is concluded when the Provider confirms the order by email or begins processing it.
The Provider may reject an order, particularly in the following circumstances:
The product is no longer in stock;
Payment cannot be processed;
The Customer has provided incomplete or clearly incorrect information;
There is a reasonable suspicion of misuse of the online store;
The product price or description contains an obvious error;
The order cannot be fulfilled for other objective reasons.
If the Provider rejects an order after payment has already been made, the payment received will be refunded without undue delay.
The contract is concluded in the Slovenian language.
Order details are sent to the Customer by email. The Customer may also request a copy of the order information by contacting the Provider.
Available payment methods are displayed during checkout.
Depending on the payment options currently enabled in the online store, the Provider may offer:
Debit or credit card payments;
Payments through electronic payment service providers;
Payment by pro forma invoice or bank transfer;
Payment on delivery;
Other payment methods displayed at checkout.
Card payments and payments processed by external payment service providers are subject to the terms and conditions of the selected payment service provider.
The Provider does not store Customers' complete payment card details.
For payments made by pro forma invoice, the Provider generally begins processing the order after receiving payment, unless otherwise stated.
The Provider issues an invoice to the Customer for the products ordered.
The Customer agrees that the invoice may be sent electronically to the email address provided when placing the order.
Where appropriate, the invoice may also be included in the shipment.
The Customer must verify the accuracy of the invoicing information before placing an order.
Subsequent changes to information on an invoice that has already been issued may not always be possible.
Products are delivered to the regions specified in the online store or available during checkout.
Estimated delivery times are indicative and begin after order confirmation or receipt of payment where payment by pro forma invoice has been selected.
Unless otherwise agreed, the Provider will deliver the goods without undue delay and no later than the statutory deadline.
Processing and delivery times may be extended during periods of increased order volumes, public holidays, promotional campaigns, product personalisation or events beyond the Provider's control.
The Provider is not responsible for delays resulting from:
Incorrect information provided by the Customer;
The recipient's absence;
Actions of the delivery service;
Weather conditions;
Traffic or logistical disruptions;
Force majeure or other circumstances beyond the Provider's control.
If a product cannot be supplied, the Provider will notify the Customer and offer the option of selecting another product, accepting later delivery or receiving a refund.
The Customer must inspect the exterior of the shipment upon receipt.
If the packaging is visibly damaged, open or shows signs of damage to its contents, the Customer should report the damage to the delivery driver and, where possible, request a damage report or photograph the shipment.
The Customer should notify the Provider of the damage as soon as possible at narocilo@robas.si and include:
Order number;
Description of the damage;
Photograph of the external packaging;
Photograph of the damaged product;
Photograph of the shipping label.
These provisions do not limit the Customer's statutory rights relating to non-conforming goods.
Customers may request order cancellation by contacting the Provider as soon as possible at narocilo@robas.si.
The Provider will cancel the order if processing has not yet begun or if the order has not yet been handed over to the delivery service.
If the order has already been dispatched, the cancellation will be treated as withdrawal from the contract, provided that the applicable conditions are met.
For personalised products, cancellation is generally no longer possible once the personalisation process has begun.
Consumers have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period begins on the day when:
The consumer, or a third party designated by the consumer who is not the carrier, acquires physical possession of the goods;
The consumer acquires physical possession of the last item or shipment where multiple items ordered in a single order are delivered separately.
To exercise the right of withdrawal, the consumer must send the Provider an unequivocal statement clearly indicating their decision to withdraw from the contract before the withdrawal period expires.
The statement may be sent:
By email: narocilo@robas.si
Or by post to:
Robas d.o.o.
Potoki 8
4274 Žirovnica
Slovenia
Consumers may use the standard withdrawal form, but its use is not mandatory.
Consumers must return or hand over the goods to the Provider without undue delay and no later than 14 days from the date on which they notified the Provider of their decision to withdraw from the contract.
The deadline is met if the consumer sends the goods before the 14-day period expires.
Goods must be returned to:
Robas d.o.o.
Potoki 8
4274 Žirovnica
Slovenia
The consumer bears the direct cost of returning the goods unless the Provider expressly states otherwise.
The Provider is not obliged to accept cash-on-delivery return shipments.
Consumers are advised to protect the product adequately during transport and retain proof of postage.
Original packaging is recommended for safe returns. However, the absence of original packaging does not, in itself, result in the loss of the right of withdrawal.
Consumers are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Consumers may inspect and test products only to the extent normally permitted in a physical store.
In the event of a valid withdrawal from the contract, the Provider will refund all payments received from the consumer, including the cost of the least expensive standard delivery option offered by the Provider when the order was placed.
If the consumer selected a delivery method more expensive than the least expensive standard delivery option, the Provider is not obliged to refund the additional delivery costs.
The Provider will issue the refund without undue delay and no later than 14 days after receiving the withdrawal notification.
The Provider may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first.
Refunds will generally be made using the same payment method used by the consumer for the original transaction, unless the consumer expressly agrees to another refund method.
Consumers do not have the right to withdraw from the contract in particular for:
Goods manufactured according to the consumer's specific instructions;
Goods customised to the consumer's personal requirements;
Personalised or engraved products;
Goods that, due to their nature, are unsuitable for return;
Sealed goods that are unsuitable for return due to health protection or hygiene reasons if the consumer has removed the seal after delivery;
Other cases specified by applicable legislation.
Selecting a standard colour, size or model from the regular product range does not, in itself, constitute personalisation.
Products featuring a name, inscription, logo, engraving or other content produced according to the customer's instructions are considered personalised products.
The Seller is liable for any lack of conformity that existed at the time of delivery and becomes apparent within the period prescribed by law.
Goods are considered to conform to the sales contract when they, in particular:
Match the agreed description, type, quantity and quality;
Have the functionality and other characteristics agreed upon in the sales contract;
Are suitable for the purposes for which goods of the same type are normally used;
Have the characteristics and quality that the customer may reasonably expect, considering the nature of the goods and public statements made by the Provider or manufacturer;
Are supplied with the agreed accessories, instructions and packaging.
Consumers who identify a lack of conformity must notify the Provider and allow the Provider to inspect the goods.
The notification should include:
Customer's full name;
Order or invoice number;
Product name;
Detailed description of the problem;
Date on which the problem was identified;
Photographs or video footage, where possible;
The consumer's requested remedy.
Notifications should be sent to narocilo@robas.si or to the Provider's postal address.
Where goods do not conform to the sales contract, consumers may, subject to the conditions prescribed by law, initially request that conformity be restored free of charge by:
Repairing the goods; or
Replacing the goods.
The Provider must restore conformity within a reasonable period, without significant inconvenience to the consumer and free of charge.
Where the statutory conditions are met, consumers may request a proportionate reduction in the purchase price or withdraw from the sales contract.
In cases prescribed by law, consumers may withdraw from the contract and request an immediate refund of the amount paid.
Consumers may not withdraw from the contract where the lack of conformity is merely minor, unless otherwise provided by law.
Consumer rights relating to non-conforming goods are not affected by any voluntary or commercial guarantee provided by the manufacturer or the Provider.
For products subject to a mandatory guarantee or covered by a voluntary guarantee, the conditions specified in the guarantee certificate or on the individual product page shall apply.
A guarantee does not exclude the consumer's statutory rights relating to non-conforming goods.
Warranty claims or claims relating to a lack of conformity generally cannot be made for damage resulting from:
Use contrary to the instructions;
Drops, impacts or other mechanical damage occurring after delivery;
Improper cleaning or maintenance;
Use of unsuitable cleaning products or accessories;
Unauthorised intervention, modification or repair;
Normal wear and tear;
Use of the product for purposes other than those intended;
Improper charging, storage or use of electronic components;
Force majeure.
Each case will be assessed individually and in accordance with applicable legislation.
The Customer is responsible for the accuracy of any text, name, initials, logo, graphics or other information submitted for personalisation.
The Provider is not responsible for errors resulting from incorrect or incomplete information supplied by the Customer.
The colours and positioning of personalisation may differ slightly from the on-screen representation due to the production technology used.
By submitting content for personalisation, the Customer confirms that they have the right to use the submitted text, photograph, logo, trademark or other content.
The Customer is responsible for any third-party claims arising from infringement of copyright, industrial property rights, personality rights or other rights relating to the content they have provided.
The Provider may refuse to personalise content that is unlawful, offensive, discriminatory, hateful, violent or otherwise inappropriate.
These Terms and Conditions apply to legal entities, sole traders and other persons purchasing products in the course of their trade, business or profession, except for provisions that expressly relate to consumers.
Business customers do not have the right to withdraw from the contract within 14 days unless otherwise agreed in writing with the Provider.
Orders for corporate gifts, bulk quantities, custom-made products, personalised products or orders based on individual quotations are also subject to the conditions specified in the relevant quotation, pro forma invoice or contract.
In the event of any inconsistency between these Terms and Conditions and an individual quotation, the provisions of the individual quotation or contract shall prevail.
The Provider complies with applicable consumer protection legislation and strives to maintain an effective complaints-handling system.
Customers may submit complaints to:
Or by post to:
Robas d.o.o.
Potoki 8
4274 Žirovnica
Slovenia
The complaint should include the customer's contact information, order or invoice number and a description of the circumstances.
The Provider will acknowledge receipt of the complaint and inform the Customer about the handling procedure.
The Provider will make every effort to resolve complaints amicably and as quickly as possible.
In accordance with the Slovenian Out-of-Court Consumer Dispute Resolution Act, the Provider informs consumers that it does not recognise any alternative dispute resolution entity as competent to resolve consumer disputes that consumers may initiate under the aforementioned Act, unless otherwise specified in an individual case.
Nevertheless, the Provider will endeavour to resolve any disputes with customers amicably.
The Provider processes personal data in accordance with applicable personal data protection regulations, including the General Data Protection Regulation (GDPR) and applicable Slovenian legislation.
Detailed information about personal data processing, processing purposes, legal bases, retention periods and individual rights is provided in the Privacy Policy published on the BERHUG website.
Personal data required to fulfil an order may be shared with contracted data processors, such as payment service providers, delivery companies, IT service providers and accounting services, but only to the extent necessary to perform the relevant service.
The Provider may send newsletters and promotional messages to users only where a valid legal basis exists.
Users may unsubscribe from newsletters at any time by clicking the unsubscribe link in a received message or by submitting a request to the Provider.
Unsubscribing from newsletters does not affect the receipt of communications necessary to fulfil an order.
Users may publish product reviews and ratings on the website if the online store provides this functionality.
The Provider may refuse or remove content that:
Contains offensive or hateful language;
Contains personal data belonging to third parties;
Is unrelated to the product;
Contains advertising or misleading information;
Violates the law or third-party rights;
Is clearly false or abuses the review system.
The Provider strives to ensure that published reviews are authentic. However, it does not guarantee that every review has been submitted by a verified purchaser unless the review is specifically identified as such.
Content on the BERHUG website, including text, photographs, videos, graphic elements, logos, product names and other materials, may be protected by copyright or other applicable intellectual property rights.
Content may not be copied, reproduced, modified, published or used for commercial purposes without the Provider's prior written permission, except where otherwise permitted by law.
The Provider strives to ensure the continuous and secure operation of the online store but does not guarantee that the website will always operate without interruptions or errors.
The Provider is not responsible for temporary website unavailability resulting from maintenance, technical problems, network outages, actions of third parties or force majeure.
The Provider is also not responsible for damage resulting from improper product use, failure to follow instructions, inadequate maintenance or use of a product for purposes other than those intended.
Nothing in these Terms and Conditions limits the Provider's liability where such limitations are not permitted by applicable law.
The Provider is not responsible for delays or failure to fulfil obligations resulting from circumstances that could not reasonably have been foreseen, prevented or remedied.
Force majeure events may include natural disasters, epidemics, wars, strikes, disruptions to transport routes, supply chain disruptions, power outages, telecommunications or information system failures, and measures imposed by public authorities.
The Provider will notify the Customer of such circumstances whenever possible and will endeavour to fulfil the order as soon as reasonably possible.
The Provider may amend these Terms and Conditions from time to time due to changes in legislation, business operations, online store functionality or other justified reasons.
The Terms and Conditions published and effective at the time the order is placed shall apply to that order.
Changes to these Terms and Conditions do not affect contracts already concluded unless required by law.
These Terms and Conditions and contracts concluded through the BERHUG online store are governed by the laws of the Republic of Slovenia.
The Provider and the Customer will endeavour to resolve any disputes amicably.
If an amicable resolution is not possible, disputes shall be resolved by the court having jurisdiction in accordance with applicable legislation.
Consumers shall not lose the protection afforded to them by the mandatory provisions of the law of the country in which they habitually reside, where those provisions apply.
If any provision of these Terms and Conditions is invalid or unenforceable, this shall not affect the validity of the remaining provisions.
These Terms and Conditions are published on www.berhug.com and take effect on 29 July 2026.
